Terms and Conditions for Events and Online Continuing Education Programs of the Oskar Killinger Foundation

  1. Organizer and Scope

The organizer is the Oskar Killinger Foundation, Am Sandtorkai 48, 20457 Hamburg, Germany.

These Terms and Conditions apply to events, webinars, online continuing education programs, live streams, and accompanying learning materials provided by the Oskar Killinger Foundation, unless otherwise stated in the respective offer.

  1. Registration and Participation

Registration takes place via the Converia event and registration platform or through another registration method specified in the respective offer.

Participants must provide complete and accurate information requested during registration. Registration becomes binding only once it has been confirmed or access to the event has been provided.

Access credentials are personal and must not be shared with third parties.

  1. Fees and Cancellation

Participation is generally free of charge unless a fee is specified in the respective offer.

Participants may cancel their registration at any time before the start of the event. There is no entitlement to the holding, repetition, or permanent availability of any event.

For paid events, the pricing, payment, and cancellation conditions specified in the respective offer shall additionally apply.

  1. Nature and Purpose of the Events

The events are intended for general information, continuing education, and professional training purposes.

Medical, therapeutic, psychological, legal, or other professional content does not replace individual consultation, diagnosis, or treatment. Medical decisions must always be made by qualified professionals taking into account the individual case, current guidelines, and applicable regulations.

No specific educational, therapeutic, professional, or economic outcome is guaranteed.

  1. Technical Requirements

Participants are responsible for ensuring the technical requirements necessary for participation, including internet connection, device, software, and audio/video functionality.

The organizer shall not be liable for technical disruptions outside its sphere of responsibility, in particular disruptions on the participant’s side or those caused by external internet or platform providers.

  1. Program Changes and Cancellation

The organizer may change the content, schedule, date, speakers, or technical platform, provided that the essential character of the event remains unchanged.

In the event of illness, technical disruptions, insufficient participant numbers, force majeure, or other important reasons, the event may be postponed, modified, or canceled.

Further claims, in particular reimbursement of travel expenses, time expenditure, loss of earnings, or consequential damages, are excluded to the extent permitted by law.

  1. CME (continuous medical education) Credits

For selected events, CME (continuous medical education) credits may be applied for. Whether and to what extent credits are recognized is determined by the respective competent medical association (“Ärztekammer”).

A prerequisite for reporting credits is, in particular, that participants provide all required information completely and accurately, especially their name and EFN (Einheitliche Fortbildungsnummer – the unique continuing education number used by German medical associations), and that personal participation is properly verified.

The participation and attendance data recorded by the event or webinar software used shall be decisive. In the case of missing, incomplete, or non-attributable information, there is no entitlement to the reporting or recognition of continuing education credits.

  1. Sponsorship, Independence, and Conflicts of Interest

Events may be supported by sponsors, funding partners, or third-party funding. Sponsors have no influence on content, topic selection, speakers, scientific evaluation, or implementation.

Sponsors and relevant conflicts of interest of speakers or active contributors will be disclosed where required. Promotional contributions, covert product advertising, or improper influence are not permitted.

  1. Conduct During the Event

Participants undertake to behave objectively, respectfully, and lawfully.

In particular, insulting, discriminatory, or unlawful contributions, disruption of the event, unauthorized advertising, and the sharing of access credentials are prohibited.

In the event of violations, the organizer may exclude participants from the event.

  1. Copyright and Materials

Documents, presentations, videos, audio recordings, scripts, and other materials are protected by copyright.

They may only be used for personal continuing education purposes. Recording, reproduction, distribution, publication, or commercial use is not permitted without the organizer’s prior consent.

  1. Recordings, Photos, and Videos

Participants will be informed before or at the beginning of the event whether the event will be recorded.

The targeted publication of identifiable participants in images, audio, or video recordings will only take place on the basis of separate consent or another permissible legal basis. During online events, participants can generally deactivate their camera and microphone.

Separate agreements regarding recordings and usage rights may apply to speakers, moderators, and other active contributors.

  1. Data Protection and Platform Use

Information regarding the processing of personal data, the use of Converia, and the rights of data subjects can be found in the organizer’s privacy policy.

Where external service providers are used, this shall be done in compliance with applicable data protection regulations.

  1. Liability

The organizer shall have unlimited liability in cases of intent, gross negligence, injury to life, body, or health, and where liability is mandatory under statutory law.

In cases of slight negligence involving the breach of essential contractual obligations, liability shall be limited to foreseeable damage typical for this type of contract. Otherwise, liability is excluded to the extent permitted by law.

In particular, the organizer shall not be liable for decisions made independently by participants based on general event content.

  1. Final Provisions

German law shall apply unless mandatory consumer protection provisions provide otherwise.

To the extent permitted by law, the place of jurisdiction shall be Hamburg, Germany.

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
