1.1. These General Terms and Conditions ("GTC") apply to participation and the related ticket sales for the aforementioned event, organized by the above-mentioned organizer. Diverging terms and conditions from participants are not valid.
1.2. The organizer reserves the right to make changes and additions to these regulations. Possible changes and additions become valid upon publication on this website.
1.3. The offer is aimed exclusively at persons of legal age.
2.1. Registration for participation in the event is only possible through the conference management & ticketing platform Converia of the Ticketing Partner, Converia GmbH.
2.2. The organizer makes an offer for the conclusion of a purchase contract with the information provided on the website. Participants accept the offer for the conclusion of a purchase contract by completing the entire ordering process and clicking on the button "Complete Registration" in the final order screen. The valid acceptance of the offer by the participants requires that they fill in all the mandatory fields (marked with "*") on the order form and have accepted these GTC.
2.3. The contract for participation in the event is concluded only after the Ticketing Partner has confirmed the registration to the participants in writing via email. Changes and/or additions to the contract must be made in writing. This also applies to the waiver of the written form requirement.
2.4. The number of participants may be limited or participation may be by invitation only. Registrations will be considered in the order of payment receipt. If participation is not possible due to overbooking, you will be notified promptly.
3.1. The price stated in the participation confirmation is the final price and binding for the participants.
3.2. All prices include applicable value-added tax (VAT), if necessary. No additional delivery and/or shipping costs will be charged unless they are explicitly stated.
3.3. If special prices for discounts (students, etc.) are granted, this will be explicitly stated. If no discounts are listed, they cannot be granted. The discount must be granted upon presentation of a proper proof (student ID). The proof must be provided before the start of the event. If the proof cannot be provided, the difference between the full price and the discounted price must be paid by the participants at the start of the event to be eligible for entry.
4.1. Payment is made through the methods specified on the website. If additional fees arise from this, they will be explicitly stated. All prices and fees are due immediately upon contract conclusion and at the latest on the day of the event.
4.2. If payment by invoice is available: If participants do not pay within 14 days after receiving the invoice, the organizer may withdraw from the contract. If the organizer withdraws from the contract, participants lose their claim to participate in the event. Any fees incurred from the transfer will be borne by the participants.
5.1. Right of Withdrawal
Participants who are consumers within the meaning of Section 13 BGB (German Civil Code) may withdraw from the contract within 14 days without stating reasons, in text form (e.g., letter, email). Participants can send an email with the ticket ID using the following contact details:
Converia Event Ticketing
Converia GmbH
Frauentorstr. 3
99423 Weimar
info@converia.de
The period begins after receipt of this instruction in text form, but not before the conclusion of the contract and not before fulfilling the organizer's information obligations in accordance with Art. 246 Section 2 in conjunction with Section 1 Para. 1 and 2 EGBGB (Introductory Act to the Civil Code) as well as the obligations under Section 312g Para. 1 Sentence 1 BGB in conjunction with Art. 246 Section 3 EGBGB. Timely dispatch of the withdrawal is sufficient to meet the withdrawal deadline.
Consequences of Withdrawal
In the case of a valid withdrawal, the mutually received benefits must be returned, and any uses derived (e.g., interest) must be surrendered. If participants are unable to return the received service or can only do so partially or in a deteriorated condition, they must provide compensation to the organizer. Refunds of payments must be made within 30 days. The period begins for participants with the dispatch of the withdrawal declaration, and for the organizer upon its receipt.
End of the withdrawal instruction
5.2. The right of withdrawal expires prematurely if the organizer begins performance of the service with the express consent of the participants before the end of the withdrawal period or if the participants initiate the performance of the service themselves.
6.1. For subsequent invoice adjustments and rebookings, a processing fee of EUR 20.00 will be charged by the organizer.
6.2. If participants do not wish to attend the event, they must declare their withdrawal from the contract in writing or via email to the organizer.
a) If the withdrawal/cancellation occurs up to 6 weeks before the event starts, the participation fee will be refunded, less a 10% processing fee.
b) If the withdrawal/cancellation occurs up to 2 weeks before the event starts, the participation fee will be refunded, less a 50% processing fee.
c) If the withdrawal/cancellation occurs less than 2 weeks before the event, no refund will be made.
6.3. If registered participants are unable to attend the event due to health reasons or an accident, they may designate a replacement person to participate. The processing fee for the rebooking is EUR 20.00.
6.4. Further cancellation rights of the participants are only granted for significant reasons. In this case, no refund will be made. 6.5. The contract partner reserves the right to prove lower expenses.
7.1. The scope of contractual services in connection with the respective event is determined by the respective informational documents, any existing registration forms, and the participation confirmation from the organizer.
7.2. If services are not provided as agreed, participants are entitled to a remedy. Deficiencies must be reported immediately. Claims for reimbursement of the participation fee due to obviously non-contractual services must be submitted within 14 days after the event concludes.
7.3. The organizer reserves the right to make short-term changes to the event program, provided they are necessary and do not restrict the core purpose of the event. In exceptional cases, the organizer may appoint a replacement speaker. Participants will be informed of any changes in due time.
7.4. Travel, accommodation, and catering are not included in the event offer unless these services are explicitly mentioned in the event description. If contract partners do not use properly offered services in full or in part, they are not entitled to a refund of the participation fee.
7.5. There is no entitlement to the development of participant-specific problem solutions.
8.1. If there is a low number of participants or for other urgent reasons, the organizer may postpone, cancel, or merge the event with other events. This also applies to the side programs and evening programs.
8.2. In the event of cancellation, the organizer will refund the payment made. The organizer may cancel the event up to 10 days before its start if the minimum number of participants specified in the event description is not reached. Shipping costs and other additional fees will only be refunded if the event cancellation is due to the intent or gross negligence of the organizer.
8.3. In the event of a change in the event date, participants have the right to withdraw from the contract. The organizer is obliged to inform contract partners promptly via one of the addresses provided at the time of booking (postal, email, phone, etc.). Sending such information will be deemed sufficient. Any travel expenses, hotel bookings, etc., that are incurred in vain will only be refunded by the organizer if the failure to inform the participants about the event cancellation is due to gross negligence or intent.
8.4. In the event of a cancellation, the participation fee will be fully refunded within 14 days. The same applies if participants withdraw due to the aforementioned reasons.
9.1. The presentations and distributed event materials are protected by copyright and may only be used for personal purposes. Usage rights are only granted by express written agreement. Reproduction, distribution, processing, or public presentation of any kind is generally not permitted and requires the written permission of the organizer.
9.2. Audio and video recordings and descriptions of the event, or of the event results in whole or in part, are not permitted.
10.1. Participants irrevocably and gratuitously consent to the organizer's right to create, reproduce, transmit, or allow the transmission of image and/or sound recordings of their person that go beyond the mere depiction of the event of the time, for all present and future media, and to use these in audiovisual media.
11.1. The liability of the organizer for contractual, quasi-contractual, statutory, tortious, or other legal grounds is excluded. The organizer and its agents are also not liable for disruptions of any kind caused by circumstances beyond their control.
11.2. The organizer will only be liable for damages if the organizer or its agents violate a fundamental contractual obligation (cardinal obligation) in a manner that endangers the purpose of the contract, or if the damage is due to gross negligence or intent on the part of the organizer or its agents. If a principal contractual obligation is negligently violated, the organizer's liability is limited to foreseeable damages, at most up to the amount of the participant price; moreover, liability for consequential and indirect damages is excluded.
11.3. The organizer will not be liable for damages that occur during travel to and from the event locations, or for losses and accidents.
12.1. Participants can visit the event website without leaving personal data. Personal data will only be collected if participants provide them voluntarily (e.g., when using website services such as purchasing tickets or registering for the event, sending a message via the website, or registering as a website user). Beyond this, no personal data is collected.
12.2. The data collected for an event (e.g., when purchasing tickets or registering for an event) will be stored, modified, and transmitted by the organizer solely for its own business purposes. This is necessary for the fulfillment of the contract (e.g., for entry control at the event).
12.3. By agreeing to these terms and conditions, participants declare: I agree that my personal participant data will be stored in machine-readable form by the organizer and collected, used, processed, and made publicly available on the event participation list as part of the organizational purpose of the event. I can hide this directly in the participation overview after registration or withdraw consent at any time via email to the organizer.
13.1. The organizer points out that in addition to its own terms and conditions, the terms and conditions for the use of the Converia Conference Management & Ticketing Platform by participants of Converia GmbH also apply as a supplement and thus form part of the preceding provisions. These are available at the following link: http://express.converia.de/agb
14.1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and other legal provisions based on or implementing international agreements or legal provisions of supranational bodies, as long as they are not of mandatory nature. This applies to claims arising from pre- and post-contractual obligations, as well as statutory claims that compete with contractual or pre- and post-contractual claims.
14.2. If individual provisions of this contract are or become invalid due to future circumstances, the validity of the rest of the contract will not be affected. Instead of the invalid provision, a rule that comes closest to what the parties would have intended applies. The same applies to gaps in the contract.
14.3. The place of performance is the organizer's registered office.
14.4. The place of jurisdiction for all disputes arising from this contract is the organizer's registered office.
