  1. General

1.1. These General Terms and Conditions ("GTC") apply to participation and the associated ticket sales for the above-mentioned event, organized by the above-mentioned organizer. Any deviating terms and conditions of the participant are invalid.

1.2. The organizer reserves the right to make changes and additions to these regulations. Any changes and additions become effective upon publication on this website.

1.3. This offer is addressed exclusively to persons of legal age.

  1. Registration and conclusion of contract

2.1. Registration for participation in the event is only possible via the Converia Conference Management & Ticketing Platform of the ticket partner, Converia GmbH.

2.2. The organizer submits an offer to conclude a purchase contract based on the information provided on the website. The participant accepts the offer to conclude a purchase contract by completing the order process and clicking the "Complete Registration" button in the final order form. Effective acceptance of the offer by the participant requires that the participant has filled in all required fields in the order form (each marked with an asterisk (*)) and accepted these General Terms and Conditions.

2.3. The contract for participation in the event is only concluded after the ticketing partner has confirmed the registration to the participants in writing via email. Changes and/or additions to the contract must be in writing. This also applies to the waiver of the written form clause.

2.4. The number of participants may be limited or exclusively "by invitation." Registrations will be considered in the order in which payments are received. If participation is not possible due to overbooking, you will be notified immediately.

  1. Prices

3.1. The price stated on the certificate of participation is the final price and binding for the participant.

3.2. All prices include VAT where necessary. Additional delivery and/or shipping costs are not charged unless stated separately.

3.3. If special prices are granted for discounts (students, senior citizens, severely disabled persons, etc.), this will also be stated separately. If no discounts are stated, they cannot be granted. The discount must be granted upon presentation of proper proof (student ID, identity card with proof of age, severely disabled person's ID card as defined by the Severely Disabled Persons' ID Card Ordinance). Proof must be provided before the start of the event. If the proof cannot be provided, the participant must pay the difference between the full price and the discounted price at the start of the event in order to be granted access.

  1. Payment

4.1 Payment is made via the methods specified on the website. Any additional fees will be shown separately. All prices and fees are due immediately upon conclusion of the contract and no later than on the day of the event.

4.2. If payment by invoice is possible: If the participant does not pay within 14 days of receiving the invoice, the organizer may withdraw from the contract. If the organizer withdraws from the contract, the participant loses their right to participate in the event. Any fees incurred as a result of the transfer are to be borne by the participant.

4.3. If payment by direct debit is possible: When paying by direct debit, the participant will be asked to enter their bank details (account holder, account number, bank code, bank institution) during the payment process. The bank details provided will be debited for the ticket amount, including any shipping costs, in the following working days.

4.4. If payment by credit card is possible: When paying by credit card (MasterCard, Visa), the participant will be asked to enter their credit card details during the payment process. The associated credit card account will subsequently be debited for the ticket amount, including any shipping costs.

4.5. If a payment is charged back (e.g., due to insufficient funds in the account specified when ordering), the participant must reimburse for any damages or expenses resulting from the chargeback. This includes, in particular, bank charges and a processing fee of € 20.00 per chargeback for processing by the organizer. In the event of an unjustified chargeback of the credit card, processing costs of € 60.00 will be charged. In the event of a chargeback, the organizer is entitled to withdraw from the contract immediately. The participant thereby loses their right to participate in the booked event. This does not affect any further claims of the organizer against the participant.

  1. Right of withdrawal

5.1. Cancellation policy

Right of cancellation:
If the participant is a consumer within the meaning of Section 13 of the German Civil Code (BGB), they may withdraw from the contract in writing (e.g. letter, email) within 14 days without giving reasons in text form. To do so, they can send an email stating the ticket ID. Participants should use the following contact details:

The period begins after receipt of this instruction in text form, but not before the contract has been concluded and not before the organizer has fulfilled its information obligations according to Art. 246 Section 2 in conjunction with Section 1 Paragraphs 1 and 2 of the Introductory Act to the German Civil Code (EGBGB) and the obligations according to Section 312g Paragraph 1 Sentence 1 of the BGB in conjunction with Art. 246 Section 3 EGBGB. To comply with the cancellation period, it is sufficient to send the cancellation in good time.

Consequences of cancellation:
In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If the participant is unable to return or surrender the received service and use (e.g. benefits of use) in full or in part, or only in a deteriorated condition, the participant must pay the organizer compensation for the value. Obligations to refund payments must be fulfilled within 30 days. The period begins for the participant with the dispatch of the cancellation notice and for the organizer with its receipt.

5.2. The right of cancellation expires prematurely if the organizer begins to provide the service with the express consent of the participant before the end of the cancellation period or if the participants arrange for the service to be provided themselves.

  1. Changes, withdrawal/cancellation

6.1. The organizer will charge a processing fee of € 20.00 for subsequent invoice changes and rebookings.

6.2. If the participant does not wish to attend the event, the participant must declare its withdrawal from the contract in writing or by email to the organizer.
a) In the event of withdrawal/cancellation up to 6 weeks before the start of the event, the participation fee will be refunded less a processing fee of € 20.00.
b) In the event of withdrawal/cancellation up to 2 weeks before the start of the event, the participation fee will be refunded less a processing fee of € 20.00.
c) In the event of withdrawal/cancellation less than 2 weeks before the start of the event, no refund will be made.

6.3. If the registered participant is unable to attend the event for health reasons or due to an accident, the participant has the option of naming a substitute for participation. The processing fee for the rebooking is € 20.00.

6.4. A further right of cancellation by the participant is only granted for good cause. In this case, no refund will be made.

6.5. The contractual partner reserves the right to prove that the costs incurred were lower.

  1. Services

7.1. The scope of the contractual service within the framework of the respective event arisis from the relevant information documents, any available registration forms, and the organizer's confirmation of participation

7.2. If services are not provided in accordance with the contract, the participant is entitled to a remedy. Defects must be reported immediately. Claims for reimbursement of the participation fee due to obviously non-contractual service must be asserted within 14 days of the end of the event.

7.3. The organizer reserves the right to make short-term changes to the content of the event program, insofar as this is necessary and does not restrict the purpose of the event, and in exceptional cases, to appoint a substitute speaker. Participants will be informed of any changes in a timely manner.

7.4 Travel, accommodation, and meals are not included in the event offer unless such services are expressly listed in the event description. If a contractual partner does not make use of properly offered services in whole or in part, there is no entitlement to a refund of the participation fee.

7.5. There is no entitlement to the development of participant-specific solutions.

  1. Cancellation of the event / date changes

8.1. If the number of participants is too low or for other urgent reasons, the organizer may postpone, cancel, or combine the event with other events. This also applies to supporting and evening programs.

8.2. In the event of cancellation of an event, the organizer will refund any payments made. The organizer may cancel the event up to 10 days before the start of the event if the minimum number of participants specified in the event description is not reached. Shipping costs and other additional fees will only be refunded if the cancellation of the event is due to intent or gross negligence on the part of the organizer.

8.3. In the event of a postponement, the participant is entitled to withdraw from the contract. The organizer undertakes to inform the contracting parties immediately at its own discretion via one of the addresses provided during the booking (by post, email, telephone, etc.). The sending of such information shall be deemed sufficient. Any wasted travel expenses, hotel bookings, etc. will only be reimbursed by the organizer if the failure to inform the participant of the cancellation of the event was due to gross negligence or intent.

8.4. In the event of cancellation, the participation fee will be refunded in full within 14 days. The same applies if the participant withdraws for the reasons stated above.

  1. Copyright and other rights

9.1. The presentations and distributed event materials are protected by copyright and may only be used for personal use. Rights of use are granted only by express written granting of the rights of use. Reproduction, distribution, processing, or public reproduction of any kind is strictly prohibited and requires the written permission of the organizer.

9.2. Audio and video recordings and descriptions of the event or its results, in whole or in part, are not permitted.

9.3 The information that participants provide to the organizer must be truthful and must not violate any third-party rights, public law regulations, or good manners. Participants in the event are responsible for keeping their contact details, in particular their email address, up to date and ensuring that the organizer can contact participants at the address provided.

  1. Images/photographs

10.1. The participants of the event consent irrevocably and free of charge for all current and future media to the organizer being entitled to create, reproduce, broadcast or have broadcast image and/or audio recordings of their person that go beyond the reproduction of a current event, as well as to use in audiovisual media.

10.2. By registering for the event, participants agree that the organizer is entitled to use the photos, films and audio recordings made during the event and to use them for public relations work and documentation related to the event.

  1. Liability

11.1. The organizer's liability for contractual, quasi-contractual, statutory, tortious, or other legal reasons is excluded. The organizer and its vicarious agents are also not liable for disruptions of any kind caused by circumstances beyond their control.

11.2. The organizer is only liable for damages if the organizer or one of its vicarious agents has breached a material contractual obligation (cardinal obligation) in a way that jeopardizes the purpose of the contract, or if the damage is due to gross negligence or willful intent on the part of the organizer or its vicarious agents. If the culpable breach of a main contractual obligation is not grossly negligent or intentional, the organizer's liability is limited to the foreseeable damage, at most to the amount of the participant fee; furthermore, liability for consequential and indirect damages is excluded.

11.3. Liability for damages occurring during travel to and from the event venues, as well as for losses and accidents, is excluded.

11.4 Downloads are made at your own risk. The organizer assumes no liability for damages that arise through no fault of the organizer as a result of downloading, installing, storing, or using data, documents, or content from the organizer's website or www.iabse.de. The organizer assumes no liability for damages or malfunctions caused by viruses or worms.

  1. Privacy protection

12.1. Participants may, in principle, visit the event website without providing any personal data. Personal data is only collected if the participant provides it voluntarily (e.g. when using website services such as purchasing tickets or registering for the event, sending a message via the website or registering as a website user). No other personal data is collected.

12.2. The data collected from participants for an event (e.g. when purchasing tickets or registering for an event) will be stored, modified and transmitted by the organizer exclusively to fulfill its own business purposes. This is necessary for the execution of the contract (e.g. for controlling admission to the event).

12.3. By agreeing to these Terms and Conditions, the participant declares: I consent to my personal participant data being stored by the organizer in machine-readable form and, within the scope of the intended purpose of organizing the event, collected, used, processed and displayed on the event participant list of the event for public access. I can hide this directly on the participant list after participant registration or revoke my consent at any time by emailing the organizer.

12.4. The participant data collected for the event will be treated in accordance with the provisions of the European General Data Protection Regulation (GDPR) and in compliance with the country-specific data protection regulations applicable to the organizer.
The organizer points out that data transmission over the internet (e.g., when communicating via email) may have security gaps. Complete protection of data from access by third parties is not possible.

  1. Supplementary provisions

13.1. The organizer points out that, in addition to its own general terms and conditions, the general terms and conditions for the use of the Converia Conference Management & Ticketing Platform by participants of Converia GmbH apply in addition and are therefore part of the preceding regulations.

  1. Final clause

14.1. The law of the Federal Republic of Germany applies, with the exception of the UN Convention on Contracts for the International Sale of Goods (CISG) and other legal provisions that are German law due to or in implementation of intergovernmental agreements or the legal provisions of supranational institutions, unless they are mandatory. This also applies to claims arising from pre- and post-contractual obligations, as well as statutory claims that compete with contractual or pre- and post-contractual claims.

14.2. Should individual provisions of this contract be invalid or lose their validity due to a later occurrence, the validity of the remaining provisions of the contract remains unaffected. The invalid contractual provisions shall be replaced by a provision that comes closest to what the contracting parties would have intended if they had considered the relevant point. The same applies to any gaps in this contract.

14.3. The place of performance is the registered office of the organizer.

14.4. The place of jurisdiction is the registered office of the organizer, insofar as this is permitted by law.
